Understanding the Fearless Foundation 11th Circuit Decision

On June 3, the U.S. Court of Appeals for the 11th Circuit ruled that the American Alliance for Equal Rights has standing to sue, that the Fearless grant program is likely to violate Section 1981, and that the Fearless Foundation grant program must remain halted under a preliminary injunction while the case proceeds in court.

While the court ruling is not the end of the case, there is concern it could set a precedent undermining the ability of 501(c)(3) public charities and private foundations to exercise their values through giving, including efforts to support historically marginalized groups.

This webinar will give an overview the 11th U.S. Circuit Court of Appeals decision and its implications. Panelists will explain the ruling's specifics, discuss what it means in practice, and frame the case in the context of ongoing legal and policy issues.
